Welcome to Luxe Photo Lounge ("Company," "we," "us," or "our"). By accessing or using our website, service descriptions, and online inquiry tools (collectively, the "Site"), you ("User," "visitor," or "Client") agree to be bound by these Terms and Conditions. Please read them carefully before browsing our site or submitting an inquiry.

1. WEBSITE USE & INTELLECTUAL PROPERTY

  • Copyright Ownership: All content on this Site—including imagery, text layouts, sample photo overlays, package descriptions, custom animated start screen samples, and logos—is the exclusive intellectual property of Luxe Photo Lounge and is protected under U.S. Copyright Law.

  • Limited License: Visitors are granted a limited, non-exclusive, non-transferable license to view and browse the Site for personal, non-commercial purposes.

  • Prohibited Actions: You may not scrape, copy, download, redistribute, or reproduce any photos or content from this Site for commercial use or vendor portfolios without express written consent from Luxe Photo Lounge.

2. SERVICE DELIVERY & BOOKING DISCLOSURES

  • Service Delivery: We provide interactive photo booth experiences, including physical prints, digital media transmission, and online event galleries.

  • Pricing Availability: All public pricing tiers (Essential Package, Luxe Package, and Premium Luxe Experience) and a la carte add-ons displayed on this Site are subject to availability. Exploring our Site or submitting a booking inquiry does not secure a date.

  • First-Come, First-Served: Booking requests are processed in the order received. Dates are only officially reserved upon the simultaneous receipt of a signed Service Agreement and a 50% non-refundable retainer.

3. PAYMENT METHODS, DEADLINES, AND SURCHARGES

  • 50% Non-Refundable Retainer: For all bookings (including private parties and corporate events), a retainer equal to 50% of the total booking fee is required at the time of booking to secure your date. Because we decline other potential business upon locking in a date, this retainer is strictly non-refundable, even in the event of client cancellation.

  • Accepted Payment Methods: Luxe Photo Lounge accepts payments via cash, debit card, and credit card. We do not accept personal or business checks, corporate Purchase Orders (POs), or Net-30/60 invoicing terms.

  • Credit Card Processing Fee: Any payments made online using a credit card will automatically be subject to a non-refundable 3% credit card processing fee added directly to the invoice total.

  • Cash Coordination: Cash payments must be coordinated and delivered in person prior to the final payment deadline.

  • Final Payment Deadline: The remaining 50% balance for all events must be settled exactly thirty (30) days prior to the scheduled event date. Inquiries or bookings made within 30 days of an event require immediate full payment.

  • Late or Missed Payments: Failure to clear the remaining balance by the 30-day deadline will result in the immediate cancellation of the booking and the automatic forfeiture of your 50% deposit.

4. LOGISTICAL & VENUE REQUIREMENTS

By using our Site to plan or book an event, you acknowledge the physical and logistical parameters required to execute our services safely:

  • Client Obligations: Clients must provide accurate event details, including date, time, and secure venue placement with access to reliable, dedicated power sources.

  • Service Footprint: Client must ensure the venue provides a minimum 10' x 10' x 10' level operational space and a dedicated 110V, 5-amp, 3-prong electrical outlet within 15 feet of the booth area.

  • Insurance (COI): If your venue requires a Certificate of Insurance (COI) or requires being named as an Additional Insured, you must provide us with the venue's exact requirements at least seven (7) business days prior to the event date.

  • Territory Limits: Stated online package rates apply exclusively to events held within Seattle, Tacoma, and the surrounding areas.

  • Excess Mileage Fee: Travel extending outside this primary service area automatically incurs an Excess Mileage Fee, which will be custom quoted based on the location and logistics of your venue and added to the total invoice.

  • Parking Fees and Valet: The Client assumes full financial responsibility for all parking costs incurred by our staff at the venue. This includes parking garage fees, venue parking lot fees, or mandatory valet charges for our transport vehicle, which will be charged directly to the Client's payment card if not pre-paid or validated by the venue.

  • Outdoor Events: Outdoor setups require a strict weather-proof, structural covering to protect our digital equipment from wind, direct sun, heat, or rain. Luxe Photo Lounge reserves the right to halt operations without refund if conditions become hazardous.

5. CANCELLATION AND EMERGENCY RESCHEDULING

  • Emergency Rescheduling: If an unforeseen emergency or Act of God (e.g., severe weather, venue closure, medical emergency) requires you to reschedule, you must notify us immediately in writing.

  • Deposit Transferability: Your 50% non-refundable deposit may be applied to a new event date, provided the new date falls within twelve (12) months of the original date and our equipment/staff are available.

  • Availability Limitations: Rescheduling is strictly subject to Luxe Photo Lounge's existing availability calendar. If a mutually agreeable date cannot be found within the 12-month window, the deposit remains entirely non-refundable.

6. SERVICE UPTIME & ARTISTIC DISCRETION

  • Operational Uptime: We guarantee an operational hardware and software uptime of at least 90% during paid event windows. Brief interruptions for normal technical adjustments (camera battery swaps, printer media paper reloads, or software resets) are normal.

  • Artistic Control: Luxe Photo Lounge retains full creative and technical control over camera configurations, lighting, prop curation, and digital filtering/editing profiles. Final photo delivery is subject to our technical quality standards, and selections are not subject to rejection or refund based on personal taste or style preferences.

7. MODEL RELEASE & USER SUBMISSIONS

  • Public Interaction: By engaging with our photo booth services at an event, guests enter a public/semi-public interactive space. All digital media captured at events remains the property of Luxe Photo Lounge.

  • Marketing Use: As detailed in our primary agreements, we reserve the right to display event imagery on this Site, our portfolios, and social media channels for marketing, educational, and promotional use.

  • Privacy Amendments: If your event requires strict privacy or corporate confidentiality, a non-disclosure amendment must be requested via email prior to booking.

8. LIABILITY & INDEMNIFICATION

  • Equipment Damage: Clients assume full monetary responsibility for any property damage, loss, or theft of Luxe Photo Lounge equipment (up to $10,000 for lost/stolen units) caused by event guests, venue staff, or other third-party vendors.

  • Limit of Liability: In the event that catastrophic circumstances beyond our control (such as severe illness, accidents, or hardware failure) prevent us from fulfilling a booking, our maximum liability is limited strictly to a full refund of payments received. Luxe Photo Lounge cannot be held liable for incidental or consequential damages.

  • Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington. Any formal disputes arising from the use of this Site or our services shall be handled through binding arbitration within the State of Washington.
