Terms and Conditions

Welcome to Luxe Photo Lounge LLC ("Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your use of our website, www.luxephotolounge.com (the "Site"), and our photo booth rental services, digital media distribution, and online hosting galleries (collectively, the "Services"). By booking our Services, signing an agreement, or using our Site, you ("Client," "Guest," or "User") agree to these Terms.

1. BOOKING AND CREDIT CARD PAYMENT TERMS

  • Service Delivery: We provide interactive photo booth experiences, including physical prints, digital media transmission, and online event galleries.

  • 50% Non-Refundable Deposit: For all bookings (including private parties and corporate events), a deposit equal to 50% of the total booking fee is required at the time of booking to secure your date. This deposit is strictly non-refundable.

  • Credit Card Payment Mandate: All payments for both private parties and corporate events must be paid via credit card through our authorized secure payment gateway. We do not accept corporate Purchase Orders (POs), checks, or Net-30/60 invoicing terms.

  • Final Payment Deadline: The remaining 50% balance for all events must be settled via credit card exactly fourteen (14) days prior to the scheduled event date.

  • Late or Missed Payments: Failure to clear the remaining balance by the 14-day deadline will result in the immediate cancellation of the booking and the forfeiture of the 50% deposit.

  • Client Obligations: Clients must provide accurate event details, including date, time, and secure venue placement with access to reliable, dedicated power sources.

2. CANCELLATION AND EMERGENCY RESCHEDULING

  • Emergency Rescheduling: If an unforeseen emergency or Act of God (e.g., severe weather, venue closure, medical emergency) requires you to reschedule, you must notify us immediately in writing.

  • Deposit Transferability: Your 50% non-refundable deposit may be applied to a new event date, provided the new date falls within twelve (12) months of the original date and our equipment/staff are available.

  • Availability Limitations: Rescheduling is strictly subject to our existing calendar availability. We cannot guarantee availability for your preferred new date.

3. VENUE ACCESS, LOGISTICS, AND INSURANCE (COI)

  • Venue Access: The Client must ensure our staff has access to the venue at least two (2) hours prior to the start time for setup, and one (1) hour post-event for teardown.

  • Corporate Venue Clearance: For corporate events held in convention centers, hotels, or restricted office spaces, the Corporate Client is responsible for securing all loading dock passes, freight elevator access, and security clearances.

  • Certificate of Insurance (COI): We maintain general commercial liability insurance. We can provide a Certificate of Insurance (COI) upon request, provided the Client requests it at least seven (7) business days prior to the event.

4. DIGITAL MEDIA, INTELLECTUAL PROPERTY, AND COMMERCIAL RIGHTS

  • Media Ownership: Luxe Photo Lounge LLC retains the copyright for all photographs, video clips, GIFs, and digital assets captured by our equipment.

  • Standard Model Release (Private Parties): By using our Services, private Clients and Guests grant us an irrevocable right to use event media for marketing, portfolios, and social media promotions.

  • Corporate Commercial License: For corporate events, we grant the Corporate Client a non-exclusive, worldwide, royalty-free license to use the event media for internal communications, public relations, and corporate marketing. We retain the right to use the media in our business portfolio unless a non-disclosure agreement (NDA) is signed prior to the event.

  • Online Galleries: We host event media in public or password-protected online galleries. We are not liable for unauthorized downloads or sharing by third parties from these galleries.

5. DATA COLLECTION AND PRIVACY

  • Privacy Policy Integration: Your use of our Services is also governed by our Privacy Policy, which explains how we collect and protect your data.

  • Information Gathered: We collect contact details from Clients for bookings, and phone numbers or email addresses from Guests at the event to transmit digital media.

  • Automated Data: The Site uses cookies to collect technical information, such as IP addresses and browsing behavior, to improve user experience.

6. EQUIPMENT SAFETY, LIABILITY, AND UNRULY GUESTS

  • Unruly Guest Behavior: We maintain a zero-tolerance policy for aggressive, abusive, or unsafe behavior. If event guests, attendees, or clients become unruly, intoxicated, or threaten the safety of our staff or equipment, we reserve the right to suspend or terminate the booth operations immediately.

  • No Refunds for Safety Shutdowns: If services are shut down early due to unruly guest behavior, the Client remains responsible for the full booking fee. No refunds or discounts will be issued.

  • Equipment Damage: The Client assumes full financial responsibility for any physical damage, loss, or theft caused to our equipment or props by event guests, venue staff, or attendees.

  • Indemnification (Corporate Events): Corporate Clients agree to indemnify, defend, and hold harmless Luxe Photo Lounge LLC from any claims, damages, or lawsuits arising from attendee actions at the event, except those caused directly by our gross negligence.

7. LIABILITY AND LIMITATIONS

  • SMS and Email Delivery: Instant digital transmission via SMS or email depends on venue network connectivity. We are not responsible for delivery delays caused by poor internet signals.

  • Service Interruptions: Our liability for technical failures, power outages, or accidental media loss is strictly limited to a prorated refund of the rental fee.

8. AMENDMENTS

  • Changes to Terms: We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the Site.
